Terms of sale

1. Seller

These terms govern sales made on heaven.audio by PALE1080, a French limited liability company (SARL) with a share capital of 100 euros, trading under the brand HEAVEN.DSP (hereinafter "HEAVEN.DSP"), registered office at 4 Rue Hans Arp, 67202 Wolfisheim, France, registered with the Strasbourg Trade and Companies Register under number 978 966 463, SIRET 978 966 463 00025. Contact: contact@heavendsp.com.

2. Products

HEAVEN.DSP sells audio processing software as plug-ins (VST3, Audio Unit) and standalone applications, delivered exclusively by download. No physical product is shipped. System requirements are listed on each product page; buyers are responsible for checking compatibility before purchase.

3. Prices

Prices are shown in US dollars (USD). Where VAT applies, it is calculated according to the buyer's country and shown before payment. The applicable price is the one displayed when the order is confirmed.

4. Order and payment

An order is binding once payment is confirmed. Payment is made by card or PayPal through Shopify's secure services. HEAVEN.DSP never has access to card details.

5. Delivery

The download link and licence key are sent by e-mail to the address given at checkout, immediately after payment is confirmed. If it has not arrived within an hour, buyers should check their spam folder, then write to contact@heavendsp.com.

6. Licence

The purchase grants a personal, non-exclusive, non-transferable licence to use the software, which may be activated on up to three computers owned or used by the buyer. The software may be used in commercial productions without further royalty.

Prohibited: reselling, renting, lending, sharing or publishing the licence key; decompiling, modifying or circumventing the software's protection measures, except where expressly permitted by law. HEAVEN.DSP retains all intellectual property rights in the software, its code, its visuals and its brand.

7. Right of withdrawal

Under Article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content not supplied on a tangible medium once performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal.

By confirming the order, the buyer requests immediate supply of the software and acknowledges losing the right of withdrawal once the download link is sent. The cases in which HEAVEN.DSP issues refunds are set out in the Refund Policy.

8. Legal guarantee of conformity

The software is covered by the legal guarantee of conformity for digital content under Articles L224-25-1 et seq. of the French Consumer Code. In case of lack of conformity, the buyer writes to contact@heavendsp.com; HEAVEN.DSP brings the software into conformity within a reasonable time or, failing that, refunds the buyer.

9. Liability

HEAVEN.DSP is not liable for loss of data, projects or revenue resulting from use of the software, nor for damage caused by improper use, an incompatible system or third-party software. This limitation does not apply to gross negligence or wilful misconduct, personal injury, or the statutory guarantees available to consumers.

10. Personal data

Data collected at checkout is processed in accordance with the Privacy Policy available on this site.

11. Mediation and disputes

These terms are governed by French law. Consumers keep the benefit of the mandatory provisions of the law of their country of residence.
